Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No.96 dated 01.07.2019, under Sections 379, 511 IPC and Sections 25, 27, 54, 59 of the Arms Act, 1959, registered at Police Station Cantonment, Amritsar. Learned counsel for the petitioner contends that the petitioner was accompanying his father Harpal Singh, who was co-accused and the allegations in the FIR are regarding an attempt to commit an offence punishable under Section 380 IPC read with Section 511 IPC. It is contended that the alleged duplicate keys of the vehicle and weapons have already been recovered from Harpal Singh. According to him, petitioner is not involved in any other case muchless of similar nature and the investigation of the case is in progress and likely to complete soon.
On the other hand, learned State counsel assisted by ASI Gurdeep has opposed the bail application. According to him, father of the Sheetal Gawri 2019.09.03 16:01 I attest to the accuracy and integrity of this document Chandigarh petitioner is involved in other cases as well.
CRM-M-34328-2019 (O & M) -2the petitioner is not involved in any other case. He submits that the petitioner is presently lodged in judicial custody. Considering the above background and the fact that the trial is likely to take some time, further detention of the petitioner may not be justified. Therefore, without meaning any expression of opinion on the merits of the case, it is ordered that the petitioner be released on regular bail subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court concerned.
The petition is allowed.
