Petitioner joined as Driver at ECHS Polyclinic, Una (Himachal Pradesh) on 04.03.2004 on contractual basis initially for a period of one year. Thereafter, contract between the parties has been renewed from time to time. As per the latest contract, Annexure P1, the term of appointment of the petitioner comes to an end on 04.03.2014. Said contract was entered into at Una in the State of Himachal Pradesh.

CWP No.9696 of 2014(O&M) [2] objection has not specifically been raised in the written statement, present writ petition is not maintainable before this Court for lack of territorial jurisdiction. Reliance is placed on judgment dated 30.06.2015 passed in CWP No.6314 of 2014 (Ex. Dr. Gurdial Singh v. Union of India and others) and other connected matters whereby writ petitions filed by similarly situated persons have been dismissed for want of territorial jurisdiction. Learned counsel for the petitioner is unable to deny the abovesaid position. It is however prayed that the petitioner be afforded liberty to approach the Court of competent jurisdiction for redressal of his grievance. Consequently, present writ petition is dismissed for lack of territorial jurisdiction however with liberty as aforesaid to the petitioner. ( LISA GILL ) October 8 , 2015.
