CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY ***** Present :

Mr. Amit Arora, Advocate for the petitioner Ms. Himani Arora, AAG Punjab ***** AMAN CHAUDHARY , J.

1.

Prayer in the present petition filed under Section 439 Cr.P.C. for the grant of regular bail to the petitioner in case FIR No.66 dated 27.02.2023, registered under Section 379(B) IPC (Sections 411 and 473 IPC added later on), at Police Station City Tarn Taran, District Tarn Taran. 2.

Learned counsel contends that the petitioner is in custody for about 6 months. The recovery of the amount allegedly snatched by him has already been effected. He submits that no test identification parade had been conducted. Challan stands presented on 27.04.2023, however, charges have not been framed. In all there are 16 prosecution witnesses. The petitioner is not involved in any other case.

3.

The custody certificate dated 15.08.2023 has been filed by learned State counsel. As per the same, the petitioner is behind bars for the last 5 months and 17 days.

- - 4.

Learned State counsel opposes the bail on the ground that there are specific allegations against the petitioner of snatching the purse of the lady and the entire amount of Rs.1,40,000/- as well as a stolen motorcycle, which he was riding, stand recovered from him. He is however unable to controvert the submissions with regard to the stage of the case and that the petitioner is not involved in any other case.
