Seeking initiation of criminal action under Section 340 CrPC against respondent No.1 for pleading wrong facts, mis-leading and concealing real facts from this Court while filing CRWP No.2525 of 2024, the petitioner has come up before this Court under Section 482 CrPC.

Counsel for the petitioner submits that based on incorrect mischievous and false facts, a Co-ordinate Bench of this Court had directed the Senior Superintendent of Police to decide the representation of petitioner-respondent No.1 herein. Because of such directions, the Senior Superintendent of Police ordered registration of FIR against the petitioner which is due to the mis-leading of respondent No.1. 3.

Counsel for respondent No.1 submits that it was not only a case of FIR but charges have been framed which shows prima facie case is made out against the petitioner and if there is any illegality, the petitioner has every right to impugn the same. 4.

Counsel for the petitioner submits that he be permitted to challenge the charges and the concerned Court should keep in mind that the representation based on which FIR was registered was on wrong facts.

Given above, the present petition is disposed of with liberty to the petitioner to challenge the order of framing of charges.
