*** ARUN MONGA, J. (ORAL) Petition herein is for grant of anticipatory bail to the petitioner in case FIR No.94 dated 19.05.2023 registered under Sections 420, 467, 468, 471, 120-B of IPC, at Police Station, Rozkameo, Nuh, District Nuh. 2.

Reply dated 04.10.2023, on behalf of respondent-State of Haryana along with Annexure R-1 (list of cases) has been tendered in course of hearing, which is taken on record.

Learned State counsel, at the outset, submits that 11 other cases are pending against the petitioner and she also refers to paras 4 and 5 of the reply, which are as under:

"4 That it is also pertinent to mention here that during the course of investigation, the relevant record was taken into possession and statement of witnesses were recorded u/s 161 Cr.P.C. The petitioner was issued a notice u/s 41 (1A) Cr.P.C for joining investigation of the case. GPA No. 2365 dated 06.12.1993 was taken into possession and it was examined upon which it was revealed that the said GPA was pertaining to small plot of land while the GPA of the petitioner is pertaining to 12 acre land. During the course of investigation, the petition preferred by the petitioner bearing No. 931, 933 along with GPA were obtained on 15.06.2023 and copy of order/judgment of CM No. 58/2016, which has been dismissed by the Ld. Court. The petitioner was joined in the investigation on 17.06.

of Nahar Singh r/o Atta, P.S. Rozka Meo was also joined in the investigation and statement was recorded. The petitioner moved a petition before the Hon'ble High Court and he has joined investigation on 20.08.2023. However, he has not cooperated during the course of investigation. He has not got recovered the aforesaid forged original GPA No. 2365 dated 06.12.1993, which was prepared with the help and assistance of co-accused Partap Singh s/o Balwant Singh r/o Jyot Satrudin, P.S. Pahadi, District Bharatpur residing in Navi Nagar, District Alwar Rajasthan and S.S. Roopra Advocate Faridabad Court complex. The accused Partap Singh was arrested on 16.09.2023 after collecting sufficient evidence against him.

He was also interrogated upon which he suffered his disclosure statement without any pressure and admitted the commission of crime and categorically stated that the original forged GPA has been kept concealed by the petitioner. Accused Kulwant Singh s/o Jhangir Singh r/o Navi Nagar P.S. Shekhpur District Bhiwani was arrested on 17.09.2023 and he was also interrogated upon which he suffered his disclosure statement without any pressure and admitted the commission of crime and he has got recovered the Typewriter with which the aforesaid GPA was typed. The aforesaid type machine was taken into possession through memo of recovery and the said memo was got attested from the attesting witnesses. 5.

That the petitioner is a clever person and he has not cooperated with the investigating officer during the course of investigation and he has not got recovered the forged GPA. The petitioner may temper the prosecution evidence and influence the witnesses, if enlarged on bail. He will absconding and hamper the investigation. Hence, the present petition is liable to be dismissed. The petitioner is a hardcore criminal and eleven cases are registered against the petitioner. A list of the pending criminal cases against the petitioner is annexed as Annexure R-1." 4.

In view of the aforesaid, no concession can be accorded to the petitioner given his antecedents.
