(Oral) The grievance of the petitioner is that the husband of the petitioner was appointed as Clerk with CONFED and a departmental enquiry was initiated against him and F.I.R was also registered against the husband of the petitioner along with other employees of CONFED of shortage of wheat. As the husband of the petitioner was not at fault, he committed suicide on 10.11.2013.

The petitioner has submitted a representation dated 28.11.2013 (Annexure P-1 colly) in this regard, but no decision has been taken thereon. The Board of Administrators in its meeting had put the liability of 10% of the shortage upon the husband of the petitioner on 20.03.2012.

C.W.P No. 77 of 2016 -2Thereafter, the petitioner got legal notice dated 13.07.2015 (P-2) served upon respondent No. 2 for release of benefits i.e leave encashment and gratuity, which would be up to the tune of Rs.6.5 lacs and Rs.10 lacs respectively but no action has been taken till date. Learned counsel for the petitioner states, that at this stage, the petitioner will be satisfied, if directions are issued to respondents to decide the representation, referred to above. In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to respondents to consider and decide the legal notice dated 13.07.2015 (P-2) of the petitioner by passing a speaking order expeditiously, in accordance with law, preferably, within a period of six months from the date of receipt of certified copy of this order.
