(Oral) This petition has been filed seeking a writ of mandamus directing the respondents to update the petitioner's application ID for the post of Post Graduate Teacher/PGT (Commerce) against the advertisement no.25/2023 dated 24.06.2023 as the petitioner has already submitted her application Id no.9147178 alongwith relevant documents against advertisement nos.32/2022 and 13/2019 issued by respondent which were withdrawn by the respondents.

Learned counsel for the petitioner contends that due to disturbance in internet service, the petitioner was unable to submit/upload her application online. Therefore, the same should now be accepted. 3.

As apparent on record, the advertisement in question, bearing no.25/2023, was issued inviting applications for PGT in the subject of Commerce from 28.06.2023 to 18.07.2023. It was specifically provided that the candidates who had already applied pursuant to advt. nos.32/2022 and 13/2019, would also have to submit fresh application. 2023:PHHC:102540 CWP No.17161 of 2023 [2] eligibility conditions regarding age, deposit of fee, etc. would be considered as per cut-off date of the respective advertisements against which the candidates had earlier applied. Such candidates were only required to provide their earlier application number, and upon entering the same, application would be verified on the basis of data already available with the Commission submitted by the candidate in response to earlier advertisement(s).

Learned counsel for the respondent-Commission, appearing on advance notice, has pointed out that thousands of applicants applied in response to the advertisement during the period. Applications were being accepted by the Commission from 28.06.2023 to 18.07.2023, there was no technical defect or disturbance in the Commission's website. 5.

In these circumstances, it cannot be accepted that on account of disturbance in internet services the petitioner was unable to apply for the post advertised. The plea appears to be false on the face of it and cannot be entertained as thousands of applications were received online. Besides, law in this respect is well settled that last date for submission of the applications cannot be extended, unless found arbitrary, or the candidates were precluded from applying on account of some technical malfunction; no such cause arises in the instant petition.

In view thereof, there is no ground to entertain the petition. 7.
