**** MANJARI NEHRU KAUL , J. (Oral) The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 346, dated 27.06.2019, under Sections 4, 6, 12 of the POCSO Act, 2012, registered at Police Station 9-A, District Gurugram.
Learned counsel for the petitioner has contended that the petitioner has been falsely implicated in the aforementioned FIR on the basis of concocted allegations and in fact no specific role has been attributed to her qua any sexual exploitation or inappropriate behaviour towards the victim. It has been further contended that the petitioner is ready to join investigation.
Heard.
In the FIR, which was registered on the complaint of the father of the victim (aged 03 years 10 months), there are specific and serious allegations against the petitioner, who is the mother of the main accused as well as the owner of the Day Care Centre, where the alleged offence was JAWALA RAM 2020.01.13 17:11 I attest to the accuracy and authenticity of this document Chandigarh committed by her son.
CRM-M-34484-2019 (O&M) - 2 - In the circumstances and after taking into consideration the serious and grave allegations against the petitioner under Sections 4, 6 and 12 of the POCSO Act, I do not deem it to be a fit case for grant of anticipatory bail to the petitioner. Accordingly, the instant petition stands dismissed.
