By way of this petition filed under Section 482 of Cr.P.C., 1973, the petitioner is seeking quashing of FIR No.234 dated 02.10.2022 for offence punishable under Sections 406, 420 of IPC, 1860 registered at Police Station Rajpura, District Patiala (Annexure P-1) and consequential proceedings arising therefrom, on the basis of compromise deed dated 10.06.2025 (Annexure P-2). 2.

Vide order dated 04.07.2025 of this Court, the parties were directed to appear before the learned trial Court/Illaqa Magistrate on 09.07.2025 for getting their statements recorded regarding the compromise arrived at between them and the Court concerned was further directed to get the statements of the parties recorded qua the compromise so arrived at between them and to submit a report in this regard.

Copy of report has since been received from learned Sub Divisional Judicial Magistrate, Rajpura in pursuance of the directions of this Court, wherein, the factum of the compromise arrived at between the parties stands verified and Sonia Puri 2025.08.02 14:37 I attest to the accuracy and integrity of this document confirmed. As per the report, compromise has indeed been effected between the

CRM-M-34247-2025 (O&M) -2-    parties and the same is without any pressure or coercion and out of their free will and the complainant has also made a statement to the effect that he would have no objection if the FIR qua the accused-petitioner is quashed. 4.

The Trial Court has annexed a copy of the statement of the respondent-party so recorded, alongwith its report. 5.

Learned State counsel also submits that there is no accused person other than the petitioner, and respondent No.2 is the only aggrieved person in the FIR in question. The petitioner is not involved in any other case.  6.

In view of the report of the learned District & Sessions Judge, Patiala and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed and FIR No.234 dated 02.10.2022 for offence punishable under Sections 406, 420 of IPC, 1860 registered at Police Station Rajpura, District Patiala (Annexure P-1) and consequential proceedings arising therefrom, are quashed qua the petitioner subject to payment of costs of Rs.10,000/- to be paid to the High Court Civil Dispensary. 7.
