CWP-27191-2018 In the present writ petition, the petitioner is seeking the interest on the delayed payment, which was made to her in pursuance of order dated 10.07.2014 passed by this Court in CWP No.3757 of 2012. Counsel for the petitioner states that as the amount was paid to the petitioner after a delay, she was entitled for the interest. The claim of the petitioner has been rejected by the respondents that there was no direction given by the Division Bench to grant interest on the payment. CWP-27191-2018 (O&M) -2Counsel for the petitioner has fairly conceded that while allowing CWP No.3757 of 2012 on 10.07.2014 there was no direction to grant the interest.

Once the Division Bench of this Court has not granted the relief of interest on the delayed payment, by this petition, the petitioner wants this Court to modify the order dated 10.07.2014 so as to grant him the benefit of interest as well, which is impermissible. Keeping in view the above facts, counsel for the petitioner prays for the withdrawal of the present petition with liberty to avail appropriate remedy for the grant of interest.
