AMIT RAWAL J. (Oral) Stand of respondents in written statement is that petitioners are not entitled to 3rd ACP as they had already been granted three up-gradation in their service career which fact is not rebutted by learned counsel for the petitioner by way of replication.

The disputed question of fact is involved which cannot be adjudicated in this Court.

Learned counsel for the petitioners seeks leave of Court for withdrawal of present writ petition with liberty to file a civil suit to prove the same.

Ordered accordingly.
