**** RAJ MOHAN SINGH, J.(Oral) Admittedly, the petitioner stands retired w.e.f. 31.05.2010. No junior person was promoted prior to the retirement of the petitioner to the post of Senior Librarian. As per the stand taken by the respondents No. 1 and 3 in Para No.4 of the preliminary objections in the written statement, the petitioner became eligible for promotion to the post of Senior Librarian on 01.10.1993 after having completed five years of regular service. The respondent-Department promoted the Senior Librarian from the post of Junior Librarian against the available vacancy of promotion quota in the year 1994 and 1996 respectively, but to determine the claim of the KUMARI SAPNA 2023.02.17 13:46 I attest to the accuracy and authenticity of this order/judgment
petitioner to promotion to Senior Librarian the seniority list of 1997 and 2005 were relevant because prior to 1997, the petitioner was not in the zone of consideration for promotion to the post of Senior Librarian. On the basis of seniority list of 30.09.1997, the employees upto Serial number 27 were promoted on 01.07.1998 to the post of Senior Librarian whereas seniority position of the petitioner was at Serial number 37. It is the specific stand of the respondent-department that the benefit or reservation for promotion of BC category was discontinued by the Government w.e.f. 16.11.1997 vide letter dated 16.06.1998, therefore, the claim of the petitioner for promotion on the post of Senior Librarian on the basis of reservation was found to be not maintainable.
In view of the aforesaid stand of the respondents No. 1 and 3 no indulgence can be granted in favour of the petitioner. Dismissed.
