Learned counsel for the petitioner argues that the petitioner was entitled for the step up of his pay equivalent to that of his junior, namely, Darshan Singh, which benefit has not been extended to the petitioner and that too, without any valid justification. Learned counsel further submits that the petitioner attained the age of superannuation on 31.05.2021 and after the said date, even the pensionary benefits have not been released to the petitioner and the gratuity of the petitioner has also been withheld. Learned counsel further submits that even the revised dearness relief as well as one month salary in lieu of LTC has not been released to the petitioner. Hence, the respondents are liable to be directed to grant the petitioner the above-mentioned benefits forthwith along with interest.
Learned counsel for the petitioner submits that the grievance which is being raised in the petition, has already been brought to the notice of the respondents vide the representation dated 06.12.2021 and legal notice dated 14.06.2022, which are still pending with the authorities, copies of which have been attached as Annexures P.17 and P.18 respectively, and RENU 2022.09.
CWP No.20235 of 2022 -2the petitioner will be satisfied in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.
Notice of motion.
On the asking of the Court, Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondents- State and raises no objection in deciding the representation dated 06.12.2021 (Annexure P.17) and legal notice dated 14.06.2022 (Annexure P.18) in a time bound manner by passing an appropriate speaking order.
In view of the pleadings in the present petition, without expressing any opinion on the merits of the case or the claim being made by the petitioner in the representation as well as in the legal notice, respondent No.2 is directed to decide the representation dated 06.12.2021 (Annexure P.17) and legal notice dated 14.06.2022 (Annexure P.18) in case the same are not decided so far, by passing a speaking order within a period of eight weeks from the date of receipt of copy of this order. Present writ petition stands disposed of.
