CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. Hakam Singh, Advocate for the petitioner.

Mr. Tapan Kumar Yadav, DAG, Haryana.

-.- JAISHREE THAKUR J. (ORAL) This writ petition has been filed seeking a writ to be issued in the nature of mandamus, directing respondents No.3 to 5 not to compel the petitioner to work for more than 48 hours in a week. Counsel for the petitioner herein would contend that the petitioner had been working as a Class-IV employee as Water Carrier. However, he was being discriminated upon and compelled to do every work other than that of a Water Carrier. He was compelled to work as a Cook/Sweeper/Gardener/ Cobbler/Barber etc. and therefore, prayed that he may be permitted to work only on the post of Water Carrier. Pursuant to notice of motion order, reply has been filed by the respondent-State wherein it is submitted that the petitioner was never compelled by the authorities to work as Sweeper/Barber/Cobbler etc. as stated by him. He was appointed as a Cook and on his request, his job profile was changed to that of Water Carrier and he continues to work as such.
