(ORAL) (The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.219 dated 07.11.2020, under Section 61 of Punjab Excise Act, 1914 registered at Police Station Nathana, District Bathinda. The allegation against the present petitioner is that a plastic container containing 40 kg of lahan was recovered from his residence.

The concession of anticipatory bail has been sought mainly on the ground that he was not apprehended at the spot and he being 66 years of age has been falsely implicated.

The instant petition is disposed of with the direction to the petitioner to surrender before the ld. trial court/Illaqa Magistrate on 11.12.2020 and file application for regular bail, which shall be decided by the ld. trial court on the same very day.
