He alleges that land of Johar/Pond/ Phirni has been encroached upon by some residents of the village against whom no action is being taken by the Gram Panchayat.

Since the alleged encroachers are not impleaded as party-respondents, it is not expedient for this Court to express any views on the petitioner's allegations. Suffice it would be to dispose of this writ petition with a direction to the Deputy Commissioner, Karnal, to depute some officer like B.D.P.O. etc. and after a fact-finding enquiry, let necessary instructions be issued to the Gram Panchayat to remove the illegal MOHINDER KUMAR 2016.05.10 16:44 I attest to the accuracy and integrity of this document Chandigarh

CWP No.7800 of 2016 [2] encroachments, if any. However, in the event of inaction on the part of the Gram Panchayat, the petitioner himself can file a petition under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961, as applicable to the State of Haryana.

The needful shall be done within a period of four months from the date of receiving a certified copy of this order.
