Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.0080 dated 17.07.2024, under Sections 194(2), 115(2), 118(1), 140(3), 351(2), 126(2), 190 of BNS (Corresponding to sections 160, 323, 324, 365, 506, 341, 149 IPC), Police Station Arniwala, District Fazilka.

It is noticed that in the head note of the present petition, it is mentioned that present petition is first bail application filed under Section 482 of BNSS. However, paragraph No.13 of the present petition, says as under:- "13.

That the petitioner has not filed any such or similar petition in this Hon'ble Court or in the Hon'ble Supreme Court of India nor any such Petition is pending before the learned Sessions Courts.

It is therefore respectfully prayed that the petition may kindly be accepted and the petitioner be released on anticipatory bail in case FIR No.0080 dated 17/07/2024 (Annexure P-1), under Sections 194(2), 115(2), 118(1), 140(3), 351(2), 126(2), 190 of BNS (Corresponding section 160, 323, 324, 365, LAVISHA 2026.06.05 14:46 I attest to the accuracy and integrity of this document PHHC, Chandigarh

It is also respectfully prayed that filing of certified copies of Annexures with the present Petition may kindly be exempted and permission may kindly be granted to place on record the Photostat/downloaded/typed/dim copies of the Annexures, in the interest of justice. It is further prayed that the arrest of the petitioner may kindly be stayed during the pendency of the present petition.

Any other order or direction which this Hon'ble Court may deem fit and proper may also be issued in favor of the present petitioner."

As per the office note, earlier also, petitioner filed one anticipatory bail petition, i.e. CRM-M-47564-2024, which was dismissed, vide order dated 01.10.2024. Thus, present petition is the second petition for anticipatory bail, filed by the petitioner.

Print out of copy of the order dated 01.10.2024 passed in CRMM-47564-2024, is taken out by the Court Secretary, which reads as under:- "After arguing for some time, when this Court was not inclined to grant anticipatory bail to the petitioner, in view of the allegations levelled against him in the crime in question, which on the face of it appears to be a premediated attack, a prayer was made by learned counsel for the petitioner for withdrawal of the instant petition. Dismissed as withdrawn."

Today, there is neither any representation on behalf of the petitioner, nor the present second anticipatory bail petition is maintainable. Accordingly, present petition is dismissed.
