The appeal was filed by the husband - Baldev Singh, challenging order dated 30.08.2011 passed by the Additional District Judge, Fatehabad dismissing his petition for grant of a decree of divorce. Neither the respondent nor any counsel on her behalf is present. FAO No.M-26 of 2012 [2] pendency of the appeal, been granted a decree of divorce by mutual consent. The appeal has, therefore, been rendered infructuous and may be disposed of accordingly.
We have heard learned counsel for the appellant and as we find no reason to doubt correctness of the statement made by counsel for the appellant, dismiss the appeal as infructuous with liberty to seek revival, in case, the statement made by the counsel for the appellant, is incorrect.
