(ORAL) The petitioner was promoted as a Manager, a common cadre post, on 30.8.2006, by the Punjab State Cooperative Bank Limited, an Apex Body, under the aegis of Department of Cooperation , Punjab. He was subsequently promoted as Senior Manager vide order dated 29.10.2010. A charge-sheet dated 16.6.2014, was issued, inter alia, for the misconduct of mis-utilisation of funds and embezzlement to the extent of Rs.2,49,75,123/-. The conclusion of the departmental proceedings resulted into the order dated 1.7.2015 (Annexure P2), being passed by the Managing Director or the Punjab State Cooperative Bank, whereby, the petitioner was removed RAJ KUMAR ARORA 2018.12.20 16:46 I attest to the accuracy and integrity of this document

The petitioner claims to have filed his statutory appeal before the Chairman, Punjab State Cooperative Limited - respondent No.3, on 16.7.2015, against his order of removal which is stated to be pending since last 3 years and hence, a prayer for direction to the Appellate Authority, to decide the pending appeal within a timeline has been made. This Court on the previous date of hearing had issued notice only to the official respondents i.e. Registrar, Cooperative Societies, Punjab and the Department of Cooperation, Punjab, so as to seek necessary instructions from the Appellate Authority, for the time needed to decide the pending appeal.

State counsel, on the instructions of Mr.Parminder Singh, Inspector, states that the pending appeal shall be positively decided by the Appellate Authority, within a period of three months. In view of above, the instant petition is disposed of with a direction to the Appellate Authority - respondent No.3, to decide the pending appeal within three months from today. The Registrar, Cooperative Societies, Punjab, shall ensure that the said above timeframe is complied with.
