Two appeals have been filed, one, by the widow and minor children and another, by the parents of deceased-Manjit Singh seeking enhancement of compensation awarded by the learned Motor Accident Claims Tribunal, Chandigarh vide common award dated 22.02.2013. FAO No.1817 of 2013(O&M) -2mediation in respect to apportionment of the compensation. The said parties amicably resolved their dispute before the Mediation and Conciliation Centre of this Court. Copy of the settlement/agreement dated 06.08.2014 is attached with this file.
None had appeared on behalf of the appellants on a number of occasions to pursue this appeal Counsel for the appellants was notified. Mr. Ashwani Arora, learned counsel for the appellants, on 03.04.2019 informed that the file of this case has been taken back by the appellants. However, it was submitted that the appellants telephonically contacted him and the case was adjourned at his request. Today, Ms. Amandeep Kaur, Advocate appearing on behalf of Mr. Arora, submits that learned counsel has no instructions in this matter. In this view of the matter, this Court is left with no other option, but to dismiss this appeal for non-prosecution and in default. Ordered accordingly. Copy of this order be conveyed to the appellants at the available address.
