Rajan Gupta, J (Oral) Petitioners have impugned the order dated 26.9.2013 passed by Superintending Canal Officer, Ludhiana. According to him, said authority has not taken all the aspects of the matter into consideration. Besides, the parties can suggest an alternate method of warabandi whereby interest of both the parties can be looked after. Prayer for remand is not opposed by learned State counsel. In view of above, impugned order passed by S.C.O is hereby set-aside. Matter is remitted to same authority for decision afresh after hearing the parties. The authority may also take into consideration the compromise, if any, between the parties.
Writ petition is allowed in these terms.
