CORAM: Hon'ble Mr. Rakesh Kumar Jain

Present:

Mr. P.S.Bawa, Advocate, for the petitioner.

***** Rakesh Kumar Jain, J. (Oral) The prayer made by the petitioner is for issuance of a writ in the nature of mandamus, directing respondent Nos.1 to 3 to stop illegal operation of bus service by respondent No.4 on Faridkot to Golewala via Hassan Bhatti, Faridkot to Pipli, Rajewala, Faridkot to Gughiana routes, which is in violation of Section 66 of the Motor Vehicles Act, 1988 (hereinafter referred to as the "Act").

The petitioner has submitted that the time table has been approved in terms of Section 72(2) of the Act but respondent No.4 is operating his bus service on the said route(s) without any valid route permit. It is further submitted that the representation made by the petitioner to the General Manager, PRTC, Faridkot, dated 30.03.2016 has not been decided by the said authority one way or the other.

The prayer is, thus, made to issue a direction to respondent No.3 to decide representation made by the petitioner dated 30.03.2016 (Annexure P-4) as early as possible.

Since the prayer made by the petitioner is found to be innocuous, therefore, the present petition is hereby disposed of with a direction to respondent No.3 to decide representation of the petitioner dated 30.03.2016 (Annexure P-4) as early as possible, preferably within a period of 15 days, from the date of receipt of certified copy of the order.
