The petitioner is seeking quashing of FIR No.27 dated 01.02.2021 under Sections 420 and 120-B IPC, 1860 registered at Police Station Sector-26 (East), Chandigarh (Annexure P-1) and all consequent proceedings arising therefrom.  2.

Learned counsel for the petitioner states that the petitioner being an old lady of 61 years of age, has no role in the offence committed by her son. However, this Court finds no ground to interfere in the present FIR, at this stage. 3.

Notice of motion.

Mr. J.S. Toor, Addl. P.P., U.T.-Chandigarh assisted by Mr. Adhiraj Toor, Advocate, accepts notice on behalf of the respondent-U.T.-Chandigarh and states that challan in the present case has been presented, however, charges are yet to be framed.  5.

I have heard learned counsel for the parties and perused the material placed on record.

No legal ground is made out to quash the present FIR, at this stage as this Court does not have jurisdiction under Section 528 BNSS, to interfere Sonia Puri 2025.07.08 18:06 I attest to the accuracy and integrity of this document

However, the present petition is disposed of, with liberty to the petitioner to raise all the pleas as stated herein, before the trial Court concerned at the stage of framing of charges. Further, keeping in view the age and role of the petitioner, in case the petitioner files an application seeking her personal exemption after the charges are framed, her application be allowed and she shall be permitted to appear through her counsel on non-essential dates.    07th July, 2025 (H.S.
