*** VIKRAM AGGARWAL, J (ORAL) This petition has been filed under Article 226 of the Constitution of India seeking issuance of a direction for protecting the life and liberty of the brother of the petitioner namely Amanpreet Singh alias Rinka, who is stated to be confined in Central Jail Bathinda on transfer from Central Jail Goindwal Sahib in case FIR No.264, dated 03.06.2018 under Sections 302, 201, 473 IPC registered at Police Station Civil Lines, Amritsar. 2.

It is the case of the petitioner that since the brother of the petitioner namely Amanpreet Singh alias Rinka had been transferred to the Central Jail Bathinda at the instance of respondents No.4 and 5 who were earlier also harassing the brother of the petitioner and were also demanding money from him, his life is in danger and there is reasonable apprehension that some wrong incident would happen with him. 3.

Though notice of motion was not issued by the coordinate Bench, Reply by way of affidavit of Sh. Shivraj Singh Nandgarh, Superintendent, Central Jail Bathinda has been filed in Court today, which is taken on record. Paragraphs 2 to 4 of the preliminary submissions of the said affidavit state as under:-

That brother of the petitioner was convicted and sentenced in case FIR No.264, dated 03.06.2018 under Section 302/201/473/120B/148/149 IPC and 25/27/54/59 Arms Act PS Civil Line District Amritsar, by the learned Court of Sanjeev Kundi, Additional Session Judge Amritsar vide order dated 15.05.2026 and sentenced as follows:- Convicted under Section Sentence Fine Rs.

In default of payment of fine 120B IPC RI for life Rs.10000/- RI for 6 months 148 IPC RI for 2 years Nil Nil read with Section 120B IPC RI for life Rs.10000/- RI for 6 months read with Section 120B IPC RI for 2 years Rs.1000/- RI for 1 month read with Section 120B IPC RI for 2 years Rs.1000/- RI for 1 month All the sentences shall run concurrently. For custody details, the custody certificate of the petitioner with other pending cases is attached herewith as Annexure R-1.

The brother of the petitioner transferred from District Jail Muktsar Sahib due to Administrative and security reasons in Central Jail Bathinda on dated 24.05.2026. (Annexure R2/T) 4.

At present the brother of the petitioner is lodged in High Security Zone A of the Central Jail Bathinda where inmates of same affiliation are also lodged. The said Zone is guarded by a team of CRPF which is supervised by Assistant Superintendent A of Jail. Senior Officers/Gazette Officers of the Jail visit the said NOTARY Security Zone on daily basis. The brother of the petitioner never submitted/communicated any letter in writing or orally regarding threat to his life."

Learned counsel for the petitioner has expressed an apprehension as regards the life and personal liberty of the brother of the petitioner. He submits that proper medical aid shall also not be granted to him in case of any untoward incident. He submits that the requisite direction be issued to the authorities concerned.

Per contra, learned State counsel, on instructions, submits that the brother of the petitioner is already lodged in a high security Zone A of the Central Jail Bathinda, where inmates of same affiliation are also lodged and the said zone is guarded by a team of CRPF, which is supervised by the Assistant Superintendent of the Jail.

Keeping in view the averments in the reply, noticed in paragraph 3, no further orders are required to be passed by this Court. However, this Court is sanguine that the authorities concerned shall comply with all rules and regulations in letter and spirit so that no untoward incident takes place. 7.

The petition is accordingly disposed of.
