Petitioner- Mandeep Singh, aged 40 years has filed instant petition under Articles 226/227 of the Constitution of India for quashing the impugned order No. 906/OASI dated 30.05.2026 (Annexure P-1) issued by respondent No. 3/Superintendent of Police, Hisar, Haryana, whereby the petitioner has been selected for promotion under List-B against 35% category for the year 2024 Lower School Course, scheduled to commence on 08.06.2026 at Madhuban, Karnal. 2.
Learned counsel for the petitioner contends that Superintendent of Police, Hisar (respondent No. 3) issued an order No. 906/OASI dated 30.05.2026, vide which the petitioner has been selected for the promotion under List-B against 35% category for the year 2024 Lower School Course, which is likely to commence on 08.06.2026 at Madhuban Karnal. She further contends that already
petitioner has submitted his unwillingness for doing the course and even one written application has also been submitted to respondent No. 3. The prime contention of counsel for the petitioner is that post of Head Constable is promotional post but looking at his own age, petitioner is unwilling to join and, thus, has made a request not to include his name in future also, in any such school course, as he wishes to retain in his present status i.e. post of Constable.

On advance notice, Mr. Amish Sharma, AAG, Haryana, who is present in the Court accepts notice and submits that similar controversy has already been decided by this Court vide decision dated 04.09.2025 passed in CWP No. 24483 of 2025, titled "EHC Sandeep Kumar and others Versus State of Haryana and others", wherein it has been held that the petitioner cannot be compelled to undergo Lower School Course and thereafter, seek promotions. He further submits that aggrieved against the aforesaid order dated 04.09.2025 passed in Sandeep Kumar's case (supra), an intra-Court appeal bearing LPA No. 122 of 2026, titled "State of Haryana and others Versus Sandeep Kumar and others" stood filed, wherein notice of motion has been issued, but no interim order has been passed.

Taking into consideration that the similar issue has already been decided in the case of Sandeep Kumar (supra) and there is no interim order passed in intra-Court appeal bearing LPA No. 122 of 2026, the present writ petition is disposed of with a direction to the respondents to re-consider the case of petitioners for the purpose of undergoing Lower School Course of the year 2024 in terms of Sandeep Kumar's case (supra).
