G.S.SANDHAWALIA, J. (Oral) After arguing for some time, counsel does not press the present writ petition and prays for withdrawal of the same with liberty to approach the Court of competent jurisdiction. This is mainly in view of the fact that the relief of promotion is sought from the date when the junior was promoted which was on 13.09.1978 as Linesman and as Junior Engineer on 25.06.2003. It is not disputed that the petitioner has already retired on 31.05.2010.

In such circumstances, this Court does not feel that this is a fit case to exercise jurisdiction under Article 226 of the Constitution of India. Accordingly, the present writ petition is dismissed as not pressed with liberty to the petitioner to avail his alternative remedy. Ordered accordingly.
