(ORAL) Prayer in this petition is for quashing of FIR No.450 dated 18.08.2022 under Section 379 IPC, registered at Police Station Sadar Nuh, District Mewat and all the subsequent proceedings arising therefrom. Learned State counsel has raised an objection that the matter is still under investigation, therefore, the present petition is premature in view of judgment of the Hon'ble Supreme Court in Niharika Infrastructure Pvt. Ltd. Vs. State of Maharashtra and others, 2021 SCC (Online) SC 315. Faced with the above, learned counsel for the petitioner seeks permission to withdraw the present petition at this stage. Dismissed as withdrawn at this stage.
