Learned counsel for the petitioner submits that the petitioner was appointed on 27.08.1993 but while framing the seniority list, the date of appointment was wrongly mentioned as 02.09.1998 and the petitioner was placed below his junior, which mistake had already been rectified by the respondents after the same was brought to their notice, hence, the petitioner is entitled for promotion to the post of Assistant with effect from the date the person junior to the petitioner was promoted with all consequential benefits.

The petitioner has already raised his grievance by serving a legal notice dated 28.07.2022 (Annexure P/9) which is still pending consideration with the respondent No.2 and the petitioner will be satisfied in case a direction is issued to respondent No.2 to decide the same by passing an appropriate speaking order in a time bound manner. Notice of motion.

In view of the pleadings in the present petition, without expressing any opinion on the merits of the case or the claim being made by the petitioner in the representation, respondent No.2 is directed to decide the representation dated 28.07.2022 (Annexure P/9), and in case the petitioner is found entitled for any relief, the same be released to him, by passing a speaking order within a period of four weeks from the receipt of copy of this order.

Present writ petition stands disposed of.
