This is third petition for grant of regular bail pending trial to the petitioner in a criminal case arising from FIR No. 36 dated 23.06.2014, registered under Section 302, 120-B & 34 IPC (Section 201 IPC was added vide DDR No. 27 dated 17.04.2018) and Section 25/54/59 of the Arms Act, 1959, at Police Station Mattewal, District Amritsar. The second petition, filed by the petitioner for grant of regular bail, was disposed of with the following order:- "This is second bail petition filed by the petitioner for grant of regular bail in FIR No.36 dated 23.6.2014 registered under Sections 302, 120-B, 34 of IPC (Section 201 IPC added later on vide DDR No. 27 dated 17.4.2018 ) and Sections 25,54,59 of Arms Act at Police Station Mattewal, District Amritsar.

First bail petition was dismissed as withdrawn on 20.8.2019. As per the information supplied by the learned State counsel on instructions from SI Jasbir, petitioner could be DEEPAK KUMAR BHARDWAJ 2021.01.15 16:08 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-40410 of 2020 arrested only on 14.4.2018, although the FIR was registered on 23.6.2014.

Learned State counsel further informs that the petitioner is involved in six other cases; out of which in two cases, he has been convicted, in two other cases he has been acquitted and two cases are still pending. Further the prosecution has already started recording their evidence. Keeping in view the aforesaid facts, this Court is not inclined to grant concession of bail at this stage. Let Additional Sessions Judge make sincere attempt to conclude the trial positively within a period of 6 months from today. Disposed of".

Learned counsel for the petitioner contends that the trial of the case has not made any substantial progress, although a period of one year has elapsed.

Since March 2020, normal functioning of the Courts was hampered due to the spread of COVID-19. Now, efforts are being made to resume the normal working of the Courts.

Keeping in view the aforesaid facts, the present petition is disposed of with the direction to the trial Court to expeditiously dispose of the trial.
