Brief Facts 1.1 Through this public interest litigation, the petitioners pray for issuance of directions to the respondents for taking immediate action for demolition of unsafe buildings, to stop illegal construction in the city of Mahendergarh, for removal of illegal encroachments in the markets and public buildings and for providing public conveniences in the city by constructing public toilets at appropriate places. 2.

Discussion and Analysis 2.1 From time to time, the reply/status reports have been filed by the respondents. In the last status report filed on 10.10.2024, it has been stated that the steps have been taken to remove the encroachments from the market

area of city Mahendergarh from time to time. The steps have also been taken for removal of 30 kiosks from both the sides of railway road i.e. Brahmadev Chowk to Anaj Mandi. The challans have also been issued against 153 violators regarding encroachment on the public places in the city of Mahendergarh. The Municipal Committee has also issued 137 notices to the shopkeepers directing them to remove encroachment within a specified time. The eviction proceedings under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971 in approximately 100 cases are being filed before the Sub Divisional Magistrate, Mahendergarh, out of which seven cases have already been filed.

2.2 The shopkeepers are also being ordered to remove the temporary encroachments from time to time. The respective owners of unsafe/dilapidated buildings are being impressed upon to demolish the same and in certain cases, entry in the unsafe buildings has been barred. At the five different locations in the city, the blocks of public toilets have been constructed for the convenience of the public. 2.3 Thus, it is evident that the substantial work has already been completed or is under way. It is further evident that various reliefs sought in the writ petition are in the nature of the steps which are required to be taken from time to time. This writ petition is pending for the last eight years. 3.

Decision 3.1 Keeping in view the aforesaid position, the present writ petition is disposed of with the directions to the District Administration including the Municipal Committee, Mahendergarh, to file monthly status report indicating the progress made in this direction with the Registrar General of

this Court which would be brought to the notice of the Bench. 3.2 The miscellaneous application(s) pending, if any, shall stand disposed of.
