VERSUS

Tajinder Singh ..... RESPONDENT(S) . . .

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .

PRESENT: - Mr. Anupam Bhardwaj, Advocate, for the petitioner. . . .

Tribhuvan Dahiya, J (Oral) This revision petition has been filed under Article 227 of the Constitution of India to issue direction to the trial court to decide the petition in a time bound manner.

At this stage, the only prayer made by learned counsel for the petitioner is that an application under Section 26 of the Hindu Marriage Act, 1955 (for short, 'Act') filed by the petitioner seeking visitation rights to meet her minor daughter and son, at a common place, who are in custody of respondent Tajinder Singh, may be ordered to be decided expeditiously. A perusal of the short orders reproduced in the petition show, despite many opportunities granted to the respondent, reply to the application under Section 26 of the Act is yet to be filed, though the petition AVIN KUMAR 2022.09.12 18:28 I attest the accuracy and authenticity of this order/ judgment.

CR No.3776 of 2022 [2] under Section 9 of the Act alongwith application under Section 26 of the Act was filed way back on 21.01.2021.

Keeping in view the above circumstances, especially the application for visitation rights filed by the petitioner, the trial court is directed to take up and decide the application under Section 26 of the Act, expeditiously.

Disposed of accordingly.
