By way of this common order, this Court intend to dispose of abovesaid both petitions as they have arisen out of the same FIR. 2.

Prayer in the present petitions has been made for grant of interim bail for extended period of 05 days i.e. from 05.06.2026 to 09.06.2026, arising out of FIR No.76 dated 19.11.2021, registered under Sections 179, 74, 140, 141, 70 and 351 of BNS and Section 6 of Protection of Children from Sexual Offence Act, 2012, at Police Station Hansi, District Hisar for attending the marriage of real sister/cousin, namely, Sunita, of the petitioners, scheduled for 05.06.2026. 3.

Learned counsel for the petitioners prays for modification of order dated 01.06.2026, passed by Ld. Additional Sessions Judge-Cum-

learned trial Court had granted them interim bail in police custody for 05.06.2026, to enable them to attend the marriage of their sister. She has contended that as it is the marriage of their sister and they be allowed the interim bail for 05 days without police custody. She has also contended that the evidence of both the sides i.e. prosecution evidence and defence evidence, is already concluded and now the case is fixed for arguments, before the trial Court, concerned. She submits that earlier also, the petitioners were granted the concession of interim bail to attend the Bhog ceremony of their grandmother, wherein they were allowed interim bail for two days i.e. from 14.01.2023 to 15.01.2023 on execution of their personal bonds without police custody, by learned Additional Sessions Judge, Fast Track Special Court, Hisar, vide order dated 12.01.2023 and thereafter, they duly surrendered before the concerned authorities. 4.

On asking of the Court, Ms. Diya Sodhi, Sr. D.A.G., Haryana (through V.C.), accepts notice on behalf of respondent-State. She has opposed the submissions made on behalf of the petitioners. She submits that as the case is fixed for final arguments on 07.06.2026 before the trial Court, thus, keeping in view the gravity of offences, the petitioners should be allowed interim bail only in the police custody. 6.

This Court finds that as it is the marriage of the sister of the petitioners and being her brothers, their presence is required in the marriage. In the attending facts and circumstances of the present case, interim bail already granted to the petitioners by learned trial Court vide

bail for a period of 02 days i.e. from 05.06.2026 to 06.06.2026, enabling them to attend the marriage of their sister which is scheduled for 05.06.2026 and they would surrender on 06.06.2026 in the evening at 7:00 pm. However, Superintendent of Police concerned is directed that the police officials, as directed by learned trial Court, be deputed in civil dress. Rest of the contents of the order dated 01.06.2026, passed by the learned trial Court shall remain intact.

Present petitions stand disposed of in above terms. 9.

A copy of this order be given under the signature of Bench Secretary of this Court.

A photocopy of this order be placed on the file of connected case.
