Rakesh Kumar Jain, J. (oral) Counsel for the petitioner has submitted that his appeal before the Commissioner, Ferozepur against the order of the Collector by which the petitioner was dismissed from the post of Harijan Nambardar of village Sohangarh, is still pending. He has approached this Court for issuance of a writ in the nature of certiorari when his application for stay was also rejected, however this Court stayed the operation of the impugned order. It is submitted that the appeal is now fixed before the Divisional Commissioner, Ferozepur on 16.12.2015.
Counsel for the petitioner submits that this petition may be disposed of by giving direction to the Commissioner, Ferozepur to decide his appeal on the date fixed and till then the order of stay passed by this Court may remain operative. CWP-8875-2015 -2this petition is disposed of with a direction to the Commissioner, Ferozepur, who is seized of the appeal filed by the petitioner against the order of the Collector by which he has been dismissed from the post of Nambardar, to decide the same on the date fixed i.e. 16.12.2015 or in case the case is adjourned, definitely on the next date of hearing. Till then the order passed by this Court staying the operation of the order passed by the Collector, shall remain operative.
