Mr. Hitesh Pandit, Addl.A.G. Haryana **** RITU BAHRI , J. (Oral) Petitioners are seeking issuance of direction to the respondents to allow them to continue on the post till regular incumbents joint in view of law laid down by this Court vide Annexure P-1.
On notice, a written statement has been filed on behalf of respondent Nos. 1 and 2 on dated 23.10.2018 stating therein that petitioners never worked as Labourer under the respondent-department. As per the policy of the Government, if any additional item of work is to be carried out or required to be carried out it can only be carried out by inviting E-tender. This procedure has been followed by the department. Petitioner Nos. 1 to 3 worked as contractor under the scheme of piece rate contract and they cannot claim casual labour worker under the respondent-department. The work in the forest department always in the nature of seasonal work and cannot be turned as regular nature. No replication has been filed by the petitioners till date. In view of the reply, the present petition stands dismissed.
