Learned counsel submits that the petitioner was entitled for consideration for promotion to the post of Assistant Professor, Psychiatry in the year, 2011 as he was eligible as per Punjab Medical Education Service (Class-I) Rules, 1978 and vacancy was available as also at the time when his juniors mentioned in para 20 of the petition, came to be promoted in 2014 and 2015, as he having earlier been inflicted with a punishment of termination, had subsequently rejoined on 12.04.2013. He further submits that the Rules, 2016 relied upon in the written statement are not applicable to his case for promotion. He thus, on instructions prays that a direction may be given to the respondents to decide the claim of the petitioner in a time bound manner. 2.

Learned counsel for the respondents has no objection to the limited prayer made.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to MOHIT 2025.07.28 15:33 I attest to the accuracy and integrity of this document

CWP-29258-2017 (O&M) -2consider and decide the claim of the petitioner, within a period of 6 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
