The petitioner was appointed as Sub Inspector in Border Security Force in the year 1993. It is stated that he was posted in various battalions in the State of J & K, Gujarat, Manipur (NorthEast), Rajasthan and Punjab. Learned counsel for the petitioner submitted that petitioner is suffering from severe depression and taking treatment regularly from Dr. S. N. Medical College & Hospital, Jodhpur (Rajasthan) since 2003. In the year 2011 petitioner was transferred from Jodhpur to Tripura. Rajasthan High Court, Jodhpur stayed the order of transfer. During pendency of the said petition, petitioner was transferred from Jodhpur to Jalandhar Frontier. Petitioner seems to have approached once again Rajasthan High Court, questioning the order of transfer from Jaipur to Jalandhar.

While disposing of the petition the respondents were directed to give lighter work. In the month of September 2012 the petitioner joined at Abohar with the Jalandhar Frontier. Now on 04.04.2016 he has been transferred from Abohar to North Bengal Frontier. Feeling aggrieved by the same he has submitted representation to the concerned authority on 01.04.2016 vide Annexure P-9. In the representation he has pleaded domestic issues like suffering illness and his wife is working as nurse in the Satellite Hospital, Mandor, Jodhpur in the State of Rajasthan. Further he has stated that his mother and father are heart patient etc. These are all the domestic problems which can be dealt by the competent authority. The second respondent, to whom the petitioner has submitted the representation to cancel his transfer (Annexure P-9), shall consider the same sympathetically within two weeks and communicate the decision to the petitioner. Accordingly the petition stands disposed of.
