Seeking quashing of the FIR captioned above, on the basis of compromise with respondent No.2, the petitioner has come up before this Court under Section 482 Cr.P.C.. 2.
Counsel for the petitioner submits that respondent No.2 is not traceable and as such notice be issued to the State.

State counsel submits that compromise is between the private respondents and petitioner and it is for the petitioner to produce respondent No.2-complainant and if he is unable to do so, the State should not be burdened to get into such private affair. 4.
At this stage, counsel for the petitioner wants to withdraw the present petition with liberty reserved to the petitioner to file fresh petition on merits because after settling the matter, the respondent-2 is not turning up to comply with the undertaking made in the said compromise.
