(Oral) Learned counsel for the petitioner submits that the petitioner applied for the post of Engineer Drawing Instructor in respect of advertisement dated 20.07.2019 but the petitioner has not been found suitable for the said post. Learned counsel further submits that the petitioner was entitled for five marks being the fatherless child which marks have not been given to him and in case the said marks are added to the score of the petitioner, the petitioner will make it to the select list. Learned counsel also submits that the respondents are liable to be directed to reconsider the claim of the petitioner by awarding him five marks for being fatherless child and, thereafter, consider his claim for appointment along with other candidates.

Notice of motion.

On the asking of the Court, Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent- State.

CWP No.20200 of 2022 -2this grievance before this Court but has not approached the Selecting Agency raising the said grievance. In case, the petitioner raises the said grievance before the Selecting Committee, appropriate consideration will be given to the grievance of the petitioner and appropriate order will be passed by the Selecting committee, within a period of two weeks of the raising of any such grievance.

Faced with this situation, learned counsel for the petitioner prays that he be allowed to withdraw the present petition qua liberty to approach the respondent - Haryana Staff Selection Commission by raising the grievance raised in the present petition by way of filing an appropriate representation. Ordered accordingly.
