Vide this common order, two petitions i.e. CRM-M-413292022 and CRM-M-43977-2022 filed by two different persons, shall be disposed of as the FIR involved in both the petitions is the same arising out of the same occurrence. However, for the sake of convenience, facts are being taken from CRM-M-43977-2022.

CRM No.40259 of 2022 :

This is an application under Section 482 Cr.P.C. for impleadment of complainant as respondent no.2 in CRM-M-43977-2022 and also for placing on record the 'Amended Memo of Parties'. In view of the averments made in the application, the same is allowed and complainant is ordered to be impleaded as respondent no.2 in the main petition bearing CRM-M-43977-2022.

'Amended Memo of Parties' is taken on record. Main Case(s) :

These are two petitions under Section 439 Cr.P.C. for grant of regular bail to the petitioners in case FIR No.310 dated 17.05.2022, under Sections 379/420/201 IPC, registered at Police Station Civil Lines Gharaunda, District Karnal.

Perusal of the record shows that the matter has been compromised between the parties. Learned counsel for the petitioners have placed on record copies of statements recorded by the Court below regarding compromise between the parties.

Status Report by way of affidavit of Manoj Kumar, HPS, Deputy Superintendent of Police, Gharaunda, District Karnal has also been placed on record.

Heard learned counsel for the parties and perused the case file. A bare perusal of the record shows that a quashing petition on the basis of compromise bearing CRM-M-42242-2022 has already been filed. Statements of both the petitioners and the complainant have already been recorded by learned Judicial Magistrate Ist Class, Karnal, regarding

entering into compromise.

Accordingly, without commenting upon the merits of the case, both the present petitions are allowed and the petitioners are directed to be released on regular bail, on their furnishing bail bonds/surety bonds, to the satisfaction of learned Trial Court/Illaqa Magistrate/Duty Magistrate, Karnal.

However, nothing contained herein above shall be construed as an expression of opinion on the merits of the case. A photocopy of this order be placed on the file of the other connected matter.
