CRM-M-37022-2024 -2yet to be ascertained during investigation, and that too, only after the petitioner joins the investigation, therefore, this Court is of the view that the petitioner's custodial interrogation is imperative.

Consequently, this Court directs the petitioner to, within 15 days from today, surrender before the learned trial court concerned and till then, his arrest shall remain stayed.

In case, the petitioner surrenders before the learned trial Court concerned within the stipulated period, and thereupon, makes an application before the latter for grant of regular bail, the latter shall make endeavour to decide the same within three days in accordance with law, but, after affording adequate opportunity of hearing to the opposite party. 7.
However, in case, the petitioner fails to appear before the learned trial Court concerned within the stipulated period, the protection granted hereinabove regarding his arrest shall stand ipso facto vacated, without further reference to this Court. It is also clariffied that the moment the petitioner surrenders, this order granting interim protection would cease to operate. 8.
It is further clarified that the learned trial Court/Judge concerned shall, while deciding petitioner's regular bail application, if any moved, not get influenced by any of the observations made hereinabove by this Court while granting interim protection to the petitioner.
