MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking quashing of FIR No.28 dated 15.09.2021 under Section 25 of the Arms Act registered at Police Station GRP Pathankot, District Government Railway Police and all subsequent proceedings arising therefrom including the order dated 18.11.2023 passed by learned ACJ(SD)/CJM, Gurdaspur, whereby the petitioner had been declared as proclaimed person. 2.

At the outset, learned counsel for the petitioner restricts his prayer for quashing of order dated 18.11.2023 vide which he was declared proclaimed person and submits that the petitioner is ready and willing to appear and surrender before the trial Court and therefore, he be protected till then and directions be given to the trial Court that his bail application, which he would be filing on his surrender, be decided expeditiously.

I have heard learned counsel for the parties and perused the relevant material on record.

In view of the limited prayer made by the learned counsel for the petitioner, the petition is disposed of with direction to the petitioner to appear and surrender before the trial Court within a period of seven days from today. Till then, no coercive steps shall be taken against the petitioner. This shall, however, be subject to payment of costs in the sum of `10,000/- to be deposited with the District Legal Services Authority, Pathankot. The petitioner is also directed to plant 03 indigenous fruit bearing trees and 03 shady trees each within the judicial complex in Pathankot, with the specific area to be identified by the District Legal Services Authority concerned within a period of seven days; the DLSA would also ensure the proper maintenance and upkeep of the trees so planted.

It is made clear that in case, the petitioner fails to surrender before the trial Court within seven days from today and to comply with the above said directions, this order shall be of no avail to him, thereafter. In case, on appearance and surrender, the petitioner moves an application for bail, the trial Court shall make earnest efforts to decide it expeditiously, in accordance with law.
