(ORAL) This is a petition that has been filed for grant of regular to the petitioner in FIR No.366 dated 01.09.2020 registered under Sections 323, 498-A, 313, 506 IPC at Police Station Pataudi, District Gurgaon. Learned counsel for the petitioner would contend that the petitioner has been falsely implicated in the said FIR as is evident from the fact that out of six persons roped in the FIR, three persons have already been declared innocent and parents of the petitioner have been allowed regular bail by the lower Court. The allegations levelled in the FIR are of general nature. Even the report of the doctor would reflect that the abortion as alleged by the complainant was not due to assault. The petitioner is in custody since 09.10.2020.
No recovery is to be effected from the petitioner, therefore, prays for grant of concession of bail to the petitioner. Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner by contending that the PANKAJ KUMAR 2021.01.
CRM-M No.40553 of 2020 (O&M) -2allegations levelled against the petitioner are serious in nature. I have heard counsel for the parties and have perused the paper book.
In view of the fact that the investigation is complete and the challan stands presented and further parents of the petitioners have already been allowed regular bail by the trial Court coupled with the fact that the trial is likely to take some time to conclude, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
