The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.735, dated 10.10.2021, Police Station City Hansi, under Sections 323 and 506 of Indian Penal Code and Sections 3(1)(r) and 3(1)(S) of Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act, 1989.

Since one of the offence in the instant case pertains to Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act, wherein a bar is enshrined under Section 18 of the Act against grant of anticipatory bail, this Court does not deem it appropriate to entertain the petition. As such, the prayer of the petitioner for grant of anticipatory bail is declined.

However, it is directed that in case the petitioner surrenders before the trial Court within a period of 10 days from today and applies for grant of regular bail in the forenoon of the day, the learned trial Court shall endeavour to dispose of the same expeditiously preferably on the very day such application is filed while duly considering the fact that it is a case wherein only simple injury is alleged to have been inflicted and the occurrence had taken place pursuant to an instance of alleged negligent driving. The trial Court while passing the order shall also consider the plea of the petitioner that he himself belongs to Backward Class community.
