H. S. Madaan, J. (Oral) Applicant - Kiran Bala, aged about 37 years, estranged wife of respondent - Gurcharan Singh, presently residing with her parents at Bathinda, has filed the instant application under Section 24 CPC, seeking transfer of civil suit filed by her husband/respondent against her, having title 'Gurcharan Singh vs. Kiran Bala' pending in the Court of Additional Civil Judge (Senior Division), Jalalabad, to a Court of competent jurisdiction at Bathinda. According to the applicant, the respondent has filed a civil suit in question against her as a tool of harassment and inconvenience and it is based upon false assertions. TA No. 681 of 2019 -2source of income and is dependent upon her aged parents for meeting her financial needs. It is inconvenient for her to travel from her parental place to Jalalabad, to attend the dates of hearing in Court there, covering a distance of 100 kms on one side. Therefore the application be accepted.
I have heard learned counsel for the applicant, besides going through the record and I find that no ground is made out to accept the application.
The nature of proceedings sought to be got transferred by way of moving the present applicant is a civil suit. Personal appearing of parties is not required in such type of proceedings and they can very well appear there through their counsel or authorized agents. Under the circumstances no ground to accept the application is there. Accordingly the same stands dismissed.
