On 02.05.2016, the following order was passed:- "Sub-para (b) of the letter dated 16.12.2014 (Annexure P-1) addressed by the National Highways Authority of India to Sh. Kulwarn Singh Atwal mentions about the provision of flyover opening at Km. 382+170, which is only 650 mtrs from the proposed location (km 392+820). It is further mentioned that in addition to this, 7 mtrs wide continuous service road is also to be constructed on both sides of National Highway from km.387.100 to km.398+720 with two way traffic facilities as per scope of work. The road users of Bholath, can use the service road and the Flyover opening at km. 392+170 for movement from left to right and vice versa. The through traffic of National Highway would pass over the 6 laned carriage way and would not interfere with local traffic.

Learned counsel for the petitioner submits that despite taking adjournments, he has been unable to ascertain the position as is mentioned in the said order. In the circumstances, he prays that for the present he may be allowed to withdraw the writ petition and if necessary file a fresh one for which liberty may be given.
Accordingly, the writ petition is dismissed as withdrawn with liberty as prayed for.
The question regarding locus standi of the petitioner to file the petition is kept open.
