(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for quashing Complaint No. 31 dated 20.03.2007, (Annexure P-1) and summoning order dated 01.05.2008 (Annexure P-9) pending before Judicial Magistrate Ist Class, Panchkula. Despite the case having been called twice, petitioner has gone un-represented.
Perusal of order dated 23.05.2018, shows that learned counsel for respondent No. 2, pointed out that petitioner was declared as proclaimed offender, vide order dated 01.09.2011, by the trial Court. In view of the above, the instant petition is dismissed being not maintainable and for want of prosecution as well. It is, however, made clear that main petition shall only be restored, in case, petitioner first surrenders before the trial Court and join the trial.
