The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) seeking issuance of appropriate directions to the official respondents to initiate criminal proceedings against the private respondents for allegedly assaulting the petitioner, thereby causing multiple injuries, including grievous injuries to his head/scalp.

Learned counsel appearing on behalf of the petitioner submits that, despite repeatedly approaching the police authorities and bringing the incident to their notice, no effective action has been taken in accordance with law. It is further contended that the petitioner sustained serious injuries in the alleged occurrence, requiring as many as 28 stitches on his scalp, and remained admitted in the hospital for a period of three days. It is also submitted that the petitioner subsequently approached the Senior

-:2:- Superintendent of Police concerned by way of a representation; however, despite such intervention, no tangible action has been initiated against the alleged assailants.

Mr. Jasjit Singh Rattu, learned Deputy Advocate General, Punjab, accepts notice on behalf of the respondent-State and submits, on instructions, that the petitioner was summoned by the investigating agency on two occasions; however, he failed to appear before the concerned police authorities.

At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied if the Station House Officer concerned is directed to take appropriate action strictly in accordance with law. Learned counsel further undertakes that the petitioner shall remain present before the Station House Officer concerned at 10:00 A.M. sharp on 04.07.2026 and shall extend full cooperation during the course of the inquiry/investigation.

In view of the statement so made and the undertaking furnished by the learned counsel for the petitioner, the present petition is disposed of with a direction to the concerned Station House Officer to record the statement of the petitioner on the date fixed, if considered necessary for the purposes of investigation, and thereafter to take all consequential steps strictly in accordance with law. The petitioner shall extend full cooperation to the investigating agency at every stage of the proceedings and shall make himself available as and when required for the

-:3:- purposes of investigation. It is, however, clarified that this Court has not expressed any opinion on the merits of the allegations, and the investigating agency shall conduct the investigation independently, objectively, and uninfluenced by any observation contained in the present order.
