(ORAL) The petitioner through the instant petition is seeking quashing of FIR No. 0112 dated 15.6.2017 under Sections 279, 337, 338, 427 and 304-A of Indian Penal Code, registered at Police Station Nehianwala, District Bathinda and judgment and order dated 26.2.2021 whereby JMIC, Bathinda has convicted the petitioner and awarded sentence of two years. Learned counsel for the petitioner, on being confronted with judgment of Division Bench of this Court in Baldev Singh vs. State of Punjab and another 2016 SCC online P&H 4509, prayed for withdrawal of the petition with liberty to point out factum of compromise before the Appellate Court. Dismissed as withdrawn with liberty as aforesaid. The Appellate Court may consider the factum of compromise while adjudicating appeal.
