By way of present petition, the petitioners have prayed for issuance of directions to the respondent to consider his proposal form, submitted in between 01.04.2015 to 30.04.2015, for running its BAMS course for the academic session 2015-16. Learned counsel for the respondent Nos.1 and 2 resisted the claim of the petitioner on the premise that if the petitioner wishes to open the College in the aforesaid course for the academic session 2015-16, it should have applied one year prior to its commencement.

Learned counsel for respondent No.3 submits that SHARMA YOGESH 2015.06.19 16:03 I attest to the accuracy and integrity of this document

CWP No.9076 of 2015 -2on receipt of complete proposal form, by any of the institution, it forwards the same to the competent authority after completing certain formalities for grant of permission to the institution concerned for commencement of the said course. I have given my thoughtful consideration to the submissions made by learned counsel for the parties. Without going into the controversy on merits, it would be just and appropriate to direct respondent No. 2 to consider the application of the petitioner, if any moved in between 01.04.2015 to 30.04.2015, to open Ayurveda College to start BAMS course for the academic session 2015-16, and pass by passing a speaking and well-reasoned order, in accordance with law.

The present writ petition is disposed of with the aforesaid observations.
