Mandeep Kaur v. State Of Punjab And ANR.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-294-2017 (O & M) Date of decision: 07.03.2019 Mandeep Kaur .... Petitioner V/s The State of Punjab and ors.
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Ms. Maninder, Advocate, for Mr. Pawan Kumar, Advocate, for the petitioners.
Mr. Nikhil Chopra, Addl.A.G., Punjab.
***** Rajan Gupta, J. (Oral) Petitioner prays for a writ in the nature of mandamus to direct the respondents to consider her for appointment to the post of Lecturer in Punjabi against one of the reserved posts of Ex-serviceman/dependent of Exserviceman. Stand of the State is that in the aforesaid categories, four Exservicemen (self) candidates were available and, thus, appointed to the post of Lecturer in Punjabi. The petitioner being dependent of Ex-serviceman could not be selected as per general condition No.7(iii) of the Advertisement and Rule 4 of the Punjab Recruitment of Ex-servicemen Rules, 1982. This court finds substance in the plea of the State. It is evident that petitioner would have no right for appointment in the case of availability of Ex-servicemen themselves.
In view of the above, the petition being without any merit, is hereby dismissed.
